At this meeting, which took place in a warm and frank climate, the minister listened to the reflections made by relatives and personally conveyed to them her support and the unwavering commitment of the Ministry of Defence, the government and the whole of Spanish society to the memory of the victims.
The minister told relatives that the opinion given by the Council of State will be followed, despite its non-binding nature. Although the ruling handed down by the courts of justice stated that the Ministry of Defence had no criminal or civil liability for the plane crash, the Council of State establishes the financial liability of the State for the YAK-42 accident, which occurred back in 2003.
The opinion states that the acknowledgement of this financial liability of the State "is not associated with the assertion of the occurrence of subjective actions that lead to any form of guilt". This opinion recognised that the compensation has already been paid out.
Lastly, the Minister for Defence expressed her full interest in collaborating with requests from relatives.
